Missouri Will Go Surgical Smoke-Free

On July 6, 2023, Missouri became the 14th state to go surgical smoke-free when Governor Parson signed HB 402 into law. The bill, which focused on rural health care, was amended at the end of the session to include language from an earlier surgical smoke evacuation bill.

Under the new law, Missouri hospital and ambulatory surgery centers accredited by the Joint Commission shall adopt and implement policies and procedures to ensure the evacuation of surgical smoke by use of a surgical smoke evacuation system. This applies only to facilities performing procedures that generate surgical smoke from the use of energy-based devices. The new law goes into effect on January 1, 2026.

Missouri Signs Smoke Bill

On Wednesday, August 30, Governor Parson held a ceremonial bill signing in Bonne Terre, Missouri, attended by AORN board member Laura Gayton, MHCA, BSN, RN, CNOR, CSSM and Missouri State Council President Lynda Lederle, RN, BSN, CNOR, BSCIS.

“AORN members across the state have dedicated themselves to advocating for surgical smoke evacuation legislation the past two legislative sessions, said Lederle. “We are thrilled with our success this year and look forward to helping facilities implement their new policies.”
